That's because here in Florida, and I imagine something similar is the case in California, to prove DUI you have to prove more than the defendant was under the influence: you have to prove that he or she was under the influence "to the extent their normal faculties were impaired," i.e., it's not necessarily criminal to drive after having had one beer or one joint. Unless AGIII lit up or had marijuana opened up in the car, the chances a cop would have caught the scent is unlikely.
