Fallujah Marine Acquitted by Civilian Jury

On this day of good news, let's have more, shall we? Yesterday another one of our brave troops who was prosecuted for doing his job was found not guilty by a civilian jury. Like the Haditha cases, this astounding perpetual prosecution of our men and women in uniform will be added into the litany of President Bush's failures, and may I say, moral corruption when it comes to our troops and our border patrol agents.

Marine acquitted in Fallujah manslaughter case

RIVERSIDE, California (AP) — A former Marine accused of killing unarmed Iraqi detainees has been acquitted of voluntary manslaughter in a first-of-its-kind federal trial.

The jury took six hours to find Jose Luis Nazario Jr. not guilty of charges that he killed or caused others to kill four unarmed detainees on Nov. 9, 2004, in Fallujah, Iraq.

Thursday's verdict marks the first time a civilian jury has determined whether the alleged actions of a former military service member in combat violated the law of war.

Here we ask our young men to go into the pit of our depraved enemy. They go, do their job and what's their thanks? Criminal prosecution. Disgusting. While he should never have had to be in this position at all, Congrats to Jose Luis Nazario Jr. on his acquittal. And a hats off to the jury who needed only six hours to figure out this man had committed no crime.

At first I was afraid that juries, many of whom have not served on active duty (with no draft and a much smaller military force) would not have the common sense and experience to figure out the real life/real death facts of war in this modern version. Thank God they did.

Aardvark, as a prosecutor I'll just say juries are extraordinarily fickle things: any attorney, no matter how experienced, who claims to really know what a jury is going to do is spouting self-important BS. I'm not very surprised a Riverside jury would acquit in this case, although I don't know enough to understand how or why this could be in civilian court.

Here's a case where a prosecuting team should be arraigned. Too many lawyers make tough combat tougher.
Now, if we could get our border patrol officers out of jail. Better yet. We should get them cleared of the heinious crime of doing their duty.
Just think if General Pershing (Punitive Expedition into Mexico) was accused of war crimes and Pancho Villa (The Butcher of Columbia, New Mexico) was invited back to testify against him.
We live in a time when silly anti-American tee-shirts are the only uniforms respected.
