This seems like a good moment to review the Tenth Amendment.

The Bill of Rights consists of the first ten amendments to the U.S. Constitution. The Constitution was adopted in 1787, and the first order of business was to amend it to protect the rights of the states and the people from Federal encroachment.

The final amendment, the Tenth Amendment, simply reads:

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

In other words, the Federal Government is only allowed to exercise powers that have been explicitly yielded to it in the Constitution. That’s the law.

How did Washington get so huge and intrusive and overwhelming when its enumerated functions are so limited? Does anyone care that what we’re seeing today is, aside being reprehensible and suicidal, also blatantly illegal?

Does citing the Constitution make me one of Janet Napolitano’s dangerous extremists?

    How did Washington come to this point ? Pride, arrogance and the love of power. People appointing themselves gods, tossing the Almighty and his commandments out the window.

    It’s the death of right and wrong and calling what is good evil and what is evil, good. We know past civilizations crumbled because of these maladies.

    Well, dear God. As someone who opposes illegal immigration, the loss of U.S. jobs to other countries, abortion, gay marriage, and the increasing size and unconstitutionality of our own United States government of late…imagine my surprise this morning when I woke up to find out that I was also a white supremacist terrorist on a rightwing extremist report issued by my own government.

    I’d have expected to receive a card, certificate, or plaque of some sort honoring such an achievement! Ed McMahon maybe? Oh wait, he has his own problems…

    Perhaps instead a pink banner with glitter, since in addition to all these other monikers I’m also a gay Republican male living in the Bible belt.

    I say I at least should get my own talk show for this, maybe Pat Robertson can feature me on “The 700 Club” as Satan’s stepchild or something…feel free to toss ideas about.

    I’m embarrassed for and scared of my own government. That’s sad. This is one of, if not THE worst, day in American history.

    Such an important message and announcement by Republican Texas Governor Rick Perry should be posted. He stood up with his 10th Amendment stand and I greatly respect the man. The Republic of Texas would not have been founded if the Regular Army and Militia had not come to agreement to work together and put aside petty differences. This is a great opening for all Conservatives, but it seemed the first thing that happened today on the show was negativity toward Perry. What a shame Tammy. You disappointed me today.

    And think of this. If the states were left without the impediments that the Federal government places upon it. The Federal Government might well start doing the things for which they are responsible.

    Go Rick Perry! Thank goodness someone is calling this President and Congress on it’s attempt to take away all rights granted by the Constitution and States.

    I’m a conservative republican, and I feel it’s imperative that my party realize that voting dynamics are changing dramatically in this country… all in favor of the left.

    I think Governor Perry is absolutely correct standing his ground on the 10th amendment. The answer is not to move to the center, but to stand our ground on the sound principles that our party was built on.

    Here’s some of the important news not reported anywhere but Fox yesterday and today:

    - Obama’s economic views are indicative of a man with no inherent or studied knowledge of economics… in fact, the foundations of his policies is a violation of even the Keynesian principles he espouses, false principles such as they are.

    - The tea parties happening all over this country. CNN thinks the First Mutt is more important. Unbelievable.

    - In USA Today it was reported that 75% of illegal immigrants have legal children. With 30 million new illegals on our 10 year horizon, where do you think the bulk of these new voters will go? And let me guess which party is courting every possible legislative initiative to make citizens out of all of them. This is big trouble for the United States in so many ways.

    One of the Founding Fathers (Jefferson?) cautioned and warned us that Governments will steal our freedoms and liberties in little bits and pieces and not all at once. That’s how it came to this.

    If we don’t stop Congress from trashing our Constitution we won’t have one left to protect in the future. Remember the words of the Declaration of Independence. It is our obligation and duty to remove Tyranical Government. That is how the United States came to be.

  9. It is very important that we remember that this nation is a union of states, not a central government with 50 (or 57) administrative districts. We are not conducting things this way, unfortunately.

    We must also remember that the American people have a government, not the other way around.

    Amen to that. The gov limits are IN the Constitution ALREADY, they just need to be adhered too and enforced. There needs to be a reeducation in this country on the Constitution and I don’t mean the liberaled down, polluted version. There is a reason correct history (if any at all) isn’t taught in public schools anymore.

    Folks, there is apparently legislation out there that can aid us in our efforts to prevent Congress and the Obama administration from usurping our will and undermining the constitution. It is the “Enumerated Powers Act” (H.R. 450), which requires that: “Each Act of Congress shall contain a concise and definite statement of the constitutional authority relied upon for the enactment of each portion of that Act.” Most courts require that litigants establish that the the court has proper jurisdiction before the court agrees to hear a cause. That is essentially the case with H.R. 450 in that it would require politicians to establish “constitutional authorities” before enrolling a bill. Essentially, they would have to prove a bills constitutional foundation before it would be submitted to Congress. So much of what is passed into law is not and would not have been considered constitutional.

    Speaking of the founders, I just ordered a Gadsden flag that was popular in the run-up to the revolution. Its the one with the coiled rattlesnake on it with the caption: “Dont Tread on Me” under the snake. I will now fly this flag under Old Glory, on all flag appropriate holidays. If anyone is interested there are a lot of revolutionary flags shirts and patches, along with state flags and country flags at flagline.com.

    As to how it came to this, Hamilton? (or was it Hancock) Was dead set against the creation of the Supreme Court. He said that it would tear down the bill or rights one by one. He was right.

    This is why I’ve been on a third party / independent rant since 2005. The federal government is run by the bigger government party, period. We’ve got to break this power mad cartel.

    Who would have thought we would see our country appear to decline to the point where the person in charge of our “homeland security”, the seemingly sleepy Janet ‘Napalotto’ Napolitano seems to point to our patiotic heroes returning from defending our country and say they are risks. Whilst at the same time she seems to approve of illegal alien criminals being free to roam our neighborhoods and having open borders so we can be freely invaded.

    What the heck, over?

    Hmm. Thank you maynard. That is a very Libertarian argument you make. Careful, apparently it is open season on Libertarian ideas right now. I am thinking I may need to soon begin an underground railroad for free thinkers here in NYS. If you should find a need to hide from persecution, look me up.

    Rick Perry is not going to save you. Neither is Jeb Bush or Romney. They will co-opt your efforts and lead you right back on the trail to big government. Please at least pay attention this time. We don’t have an infinite number of chances to choose the right people.
