Things got ugly when…

…one of the bondholder firms, Perella Weinberg, rejected the Obama deal that would give the bondholders about 33 cents on the dollar for their secured debts while giving the United Auto Workers retirees about 50 cents on the dollar for their unsecured debts.

This of course is a violation of one of the basic principles of bankruptcy law, which is that secured creditors — those who lent money only on the contractual promise that if the debt was unpaid they’d get specific property back — get paid off in full before unsecured creditors get anything.

After that came a denunciation of the objecting bondholders as “speculators” by Barack Obama in his news conference last Thursday.

This connects to the story previously reported about a bondholder firm that “was directly threatened by the White House and in essence compelled to withdraw its opposition to the deal under threat that the full force of the White House press corps would destroy its reputation if it continued to fight.” These are the words of the bondholder representative, a man who also happens to be a big Democratic donor.

The conclusion is inescapable and chilling:

Think carefully about what’s happening here. The White House, presumably car czar Steven Rattner and deputy Ron Bloom, is seeking to transfer the property of one group of people to another group that is politically favored. In the process, it is setting aside basic property rights in favor of rewarding the United Auto Workers for the support the union has given the Democratic Party. The only possible limit on the White House’s power is the bankruptcy judge, who might not go along.

Michigan politicians of both parties joined Obama in denouncing the holdout bondholders. They point to the sad plight of UAW retirees not getting full payment of the health care benefits the union negotiated with Chrysler. But the plight of the beneficiaries of the pension funds represented by the bondholders is sad too. Ordinarily you would expect these claims to be weighed and determined by the rule of law. But not apparently in this administration.

Obama’s attitude toward the rule of law is apparent in the words he used to describe what he is looking for in a nominee to replace Justice David Souter. He wants “someone who understands justice is not just about some abstract legal theory,” he said, but someone who has “empathy.” In other words, judges should decide cases so that the right people win, not according to the rule of law.

The Chrysler negotiations will not be the last occasion for this administration to engage in bailout favoritism and crony capitalism. There’s a May 31 deadline to come up with a settlement for General Motors. And there will be others. In the meantime, who is going to buy bonds from unionized companies if the government is going to take their money away and give it to the union? We have just seen an episode of Gangster Government. It is likely to be part of a continuing series.

    This is the mindset of total governmental control. We now have the UAW in Obama’s hip pocket, and vice-versa. 55% of Chrysler now controlled by the very entity that caused them to go under, and now acting as a puppet to the democratic party.

    How can this happen? Same way that ACORN went unpunsished while putting wayward unregistered voters into the voting booths, and ensuring that huge donations into the 10′s and even 100′s of thousands were laundered under the 2000 dollar individual max.

    “Lauria told a Detriot radio station last week that the White House had threatened to use the White House press corp to ruin the reputation of Perella Weinberg if the firm continued to oppose the administration’s plans for restructuring Chrysler. He later identified Steve Rattner, Obama’s Car Czar, as the man who made the threats.”

    Tell me this isn’t fascism. This administration is making Bill Clinton’s foibles pale by comparison.

    Well, thus far they have made leaping gains toward the nationalization of our banking, insurance, healthcare, and education systems. Why bother to even vote next election when the deck is already well-stacked against any conservative opponents?

    Witness the modus opperandi of Barrako Obamalini, as he consoldates power to reward his constituency and punish whoever speaks against his will. Will Repblicans dismatle what he has inflicted on us if they regain power in 2010? I think not. Washington itself is absolutely corrupt. Deciding matters of law in favor of who “should win” will quickly turn into deciding in favor of the supporter, and eventually the “party member”.

    You know, he keeps saying, as he did in his “100 days of Hell” speech, that he doesn’t want to run the car companies, or the banks, etc.

    But this speaks to the opposite, does it not?

    And yes, where are the Republicans?

    And as a lawyer I should know exactly how we can bring this to the Supreme Court but I can’t think of how exactly to do that right now, but I do feel that we need their involvement. I know the deck is still kind of stacked against us on the Court, but still, I need to hear from them to confirm whether or not we still have a Constitution.

    Because it’s beginning to look like the President and all in his admin have forsaken the Oath they took and I think for that they should be thrown out of office. Well, including any other politicians, regardless of the letter after their name.

    This is getting serious folks. Our Constitution is beginning to mean nothing at all – bills of attainder, ex post facto, and now this (among a host of other things).

    When will it end?

    We need one serious Tea Party on the 4th of July. One where we are unequivocally stating that we are DONE and that the Constitution will be followed and upheld, OR ELSE. I can’t think of any other way to go.

    I don’t think 2010 is going to be any help as far as taking care of this “legitimately”, which, BTW, I’m happy to do, if I think that it will even matter.

    For the longest time, I got the feeling that it didn’t matter, but I thought maybe I was wrong and just jaded.

    It’s official, I don’t think the elections matter and haven’t mattered for some time and I think we need to follow the Declaration of Independence here and “clean house”.

    Do you here that, J-No? Good. Put that in my file, you Nazi pig.

    And who owns positions in these hedge funds that are being abused? You and I do.

    Our 401s own positions. Our retirement accounts own positions. Our savings accounts own positions.

    By countenancing this, we are allowing robbery from our very own pockets.

    Johnny has been afraid of “The One” and the MSM forever. GO back to how he blasted a warm up speaker at one of his events last August – ref The One’s middle name.
    The GOP the last 9 years has been the party of jellyfish and cowards. What is worse is they have purged anyone with b*lls – think Tancredo. The “leaders” of the GOP are wimps and proud to be wimps!

    Uuuuuugggghhhhh! I am chiming in with everyone who thinks the silence of the GOP is disgusting! If any GOP politicians expect to keep their jobs in the next election cycle, they need to pay attention. They are not led around by the nose by the democrats right now. We will lead them around by the nose. We will lead them into the same conservative politics that led Reagan into a 49 state victory in 1980. It baffles me no end why the GOP thinks capitulating to liberal ideology is the answer right now. Americans want conservative ideals! They want to keep their own damn money! Criminy! How difficult is it to hire some PR folks to write this stuff up? It’s not rocket science. The GOP is worthless. That is why I have quit the GOP as of last year. They will have to wine and dine, to get me back. Stupid suckers….
