Interesting that this case has occured in part because of our high college costs. Need to lay the blame for high college costs where it belongs, the schools themselves. Defendant is just doing what used textbook stores do except his ‘used’ textbooks have never been opened.
This is the free market responding to high prices, eg, if prices get too high in one place, people will buy product at cheaper available place. Also, this is the flip side to different tax rates between countries. The reason this product reselling issue doesn’t occur with drugs sold cheap in other countries is because you need a doctor’s approval and you can’t buy in bulk to do resales. Just because plaintiff is a company doesn’t mean that it doesn’t want gov’t to act in a marxist manner so company can have a monopoly.
And if defendant loses, will foreign car manufacturers claim that because autos are built in USA then they can be resold by purchaser. Because if not, foreign car manufacturers will get killed because who will want to buy a car that you need approval from Japan or Germany to resell? Gov’t motors must be hoping. Hope & change.
