Once again, the 9th Circus Court is overturned by SCOTUS. This time on a technicality, but the result, at least so far, is that the part of Arizona’s Prop 200 which requires voters to show an ID prior to voting, can proceed. This is excellent news for the time being, but the fight is not yet over. The Volokh Conspiracy also has analysis and the full 6-page opinion.

Supreme Court upholds Arizona’s photo ID law for elections

Arizona voters will have to present identification at the polls on Nov. 7 after all.

The U.S. Supreme Court ruled Friday that Arizona can go ahead with requiring voters to present a photo ID, starting with next month’s general election, as part of the Proposition 200 that voters passed in 2004. The ruling overturns an Oct. 5 decision by the 9th Circuit Court of Appeals, which put the voter ID rules on hold this election cycle.

The Supreme Court on Friday did not decide whether the new voter ID rules are constitutional. That decision is still pending in federal district court. Instead, the court decided that the 9th Circuit made a procedural error by granting an injunction to put the new rules on hold without waiting for the district court to explain its reasons for not granting an injunction.

Here’s what the WaPo ran, in part, regarding the issue:

WASHINGTON (Reuters) – The U.S. Supreme Court ruled on Friday that Arizona may require voters to present proof of citizenship when registering to vote and identification when they cast their ballots in the November 7 elections.

“Given the imminence of the election and the inadequate time to resolve the factual disputes, our action today shall of necessity allow the election to proceed without any injunction suspending the voter identification rules,” the court said…

Last month, in a move also aimed at illegal immigrants, the House of Representatives approved a bill to require proof of U.S. citizenship to vote in federal elections.

Opponents of the Arizona law said it discriminated against minorities and the poor, who might not have funds to obtain the necessary proof of identification.

Please. What strikes me is that the “constituencies” of the left apparently have no problem with being cast as complete incompetents in the effort to overturn this law. With a law meant to make sure only legal citizens vote (how dare they!), various leftist groups argue that asking people of color, the poor or seniors is either too complicated or “don’t have the money” for ID. In other words, those kinds of people are so unhinged, so unable to control their own lives that they’re walking around without wallets, without identification, without checking accounts, and consequently without lives. After all, if we’re going to speak about the poor, in order to get welfare, social security or other assistance you have to have ID. And people of color? The insult to suggest that a person’s complexion makes them stupid and useless is an outrage.

Really now, when are these leftist “constituencies” going to have enough being taken for granted and portrayed in this manner?

The truth of the matter is, leftist groups want illegal aliens to vote because they know people invested in America won’t. They want what they see as another potential voting block which can be cast as “victimized” educated in victimhood, and voila, another constituency with lives to ruin and futures to destroy.

Asking voters to show ID is common sense in this world where our borders are hemorrhaging, and if you have respect whatsoever for Americans, including those pesky ones with darker complexions and those who are struggling financially, expecting them to have ID is not unreasonable.

There are provisions for those without IDs
but that’s also apparently not good enough for groups like MALDEF and the ACLU. Why? Because the law will indeed keep illegals from voting.

Stop the ACLU also has coverage of the issue. While this coming election is safe for Voter ID, we still have to await the district decision. Tammy Blog will keep you informed. In the meantime, keep up the good work Arizona!

If I walk into Blockbuster and ask to rent movies and they refuse me because I won’t show them my identification, can I sue them for discrimination? Are talkin horses a protected class?

To buy beer or cigarettes you must by law present ID to the seller. Why not to vote? Is not voting more important than smoking?

Since when has it been okay NOT to show ID to vote? At the very least, I’ve had to show my voter registration card at my local polling place and then filled out a form or two certifying that I’m an eligible voter.

What we need is a single baseline standard for voting eligibility and stick to it.

It’s a sign of just how pathetic the Dhimmis have become that they must rely on illegal aliens, dead people, and convicted felons voting in order to win elections. And their second tactic: running against someone who isn’t running (Tom DeLay, Mark Foley) after making sure that some judge will prevent the Republicans from running someone else. How utterly pathetic!
