Faced with a wave of potential homegrown Islamic State supporters, the Federal Bureau of Investigation is embarking on a new approach with some suspects: putting them in counseling rather than handcuffs….

“Nobody wants to see a 15-year-old kid go to jail if they don’t have to,’’ said one official working on the effort. That official said that when the FBI recommends a potential suspect for counseling, the criminal investigation will continue and agents will be prepared to make an arrest if they believe the person becomes more dangerous….

The approach is increasingly embraced by the Obama administration as part of a broader initiative federal officials call countering violent extremism, or CVE—which focuses on countering terrorist propaganda and spotting problematic behavior early.

Don Borelli, a former FBI counterterrorism official, noted the approach has been used in Europe for years, and said that with proper legal guidance and training, could work here.

….The approach has prompted spirited debates among some federal law enforcement officials. For years the FBI stayed away from intervention, with senior officials arguing their agents weren’t social workers, according to current and former officials.

Some of those officials worry that if someone referred for counseling ends up killing people, the FBI would be pilloried for treating the person with kid gloves. Others have raised questions about legal liability, and whether the government should have a formal, written mechanism for telling doctors, teachers or others that they won’t be held responsible if someone turns violent.

John Cohen, a former Department of Homeland Security official, said intervention is still viewed skeptically by many traditional counterterrorism officials. But he said the approach could help law enforcement better understand the psychological profiles of suspects to help prevent violence by recognizing “stressors’’ that may turn a person violent….

    If you’re arrested for supporting terrorists, you can’t legally purchase a firearm. Will the terrorist supporters under ‘counseling’ be placed on the ‘can’t purchase firearm’ list or would that be violating their 2A rights because they haven’t been arrested. I support the latter position that if not arrested, they can’t be placed on can’t purchase list. Hope ACLU will too. Wonder if this is partly a ploy to put We the People, especially the NRA, in an Obama false choice situation. Eg, if you support not putting suspected terrorist supporters on list, then you’re a gun-toting racist like the South Carolina church shooting loon. Whereas if you do support putting on can’t purchase list, then you recognize that something other than arrest or mental hospitalization is appropriate to remove 2A rights.

      To carry my conspiracy theory forward; State Dept. has largely been calling terrorist groups those that the Southern Poverty Law Center declare as terrorist groups. And IRS has been requesting donor lists of Tea Party 504 non-profit orgs. So if firearms can be banned for terrorist supporters that have not been arrested, and Tea Party 504 orgs. are on terrorist org. list, then donors are terrorist supporters who can have their 2A rights removed.
