While I certainly don’t agree with going as far as suing, I don’t find it that outlandish, as it does sound like (after reading the article) the teens were fairly responsible for the accident. I do think that too many times we automatically assume the pedestrians/cyclists are always the victims in these accidents.
I could see that as a reason to dismiss a lawsuit against the motorist. But for God’s sake, not *everything* is about you, darling! How do you get into a mental space where you can sue the family of the boy you killed for “lessening your enjoyment of life”?
I’d want to get more facts before forming a judgment. Here’s a report indicates a couple of relevant points. One:
If that’s a fair statement of facts, then the driver might reasonably not have been at fault. I’m a bike rider myself, often at night, and one of my serious concerns is other bikes without lights or reflectors. They can be invisible! (The picture of the boy on the bike shows a bike without lights or reflectors. He shouldn’t be in the street at 1 A.M.!)
Also…
A countersuit is a routine procedure when you get sued, especially if you’re sued unreasonably. You ask your lawyer how to defend, and he says “Countersue”. That is, it’s not the same as the driver filing a suit on her own volition.
Under the circumstances, there’s the *possibility* that this driver is not behaving unreasonably.
